Terms and Conditions for Members (Member Terms)

The Member Terms govern the relationship between you, the member who is seeking employment (Member) and Bozzii Pty Ltd ACN 616 459 762 (Bozzii). You must read the Member Terms carefully before you create an account and use Bozzii’s website or mobile app.Contact Bozzii if you have any questions. By creating an account you agree to be bound by the Member Terms

You must be 16 years of age in order to register as a Member. If you are under the age of 18you must have the permission of your parent or guardian to become a member

  1. Role of Bozzii
    • Bozzii is a facilitator only. Bozzii’s role is to assist you find employment by allowing you to access positions vacant posted on Bozzii’s website and mobile app by a potential employer (Potential Employer).
    • Bozzii does not enter any agreement for you or on your behalf. You will communicate and contract directly with the Potential Employer. Bozzii will not get involved in any disputes between you and a Potential Employer whether or not you are employed by them.

  2. Your obligations
    • You must, at all times, answer all questions honestly, correctly and completely including when you create your account, register the details of your experience on the Bozzii website and when you talk to Potential Employers.
    • As a member you do not have to pay any fees to register with Bozzii or use the website or mobile app. Once you have created your account, you will have full access to the content of the Bozzii website and mobile app and you will be able to interact with the website and mobile app including by adding images, comments and reviews of employers.
    • You agree that any information you provide to Bozzii when you create your account can be used by Bozzii in accordance with Bozzii’s Privacy Policy.
    • It is your responsibility to negotiate the terms of your employment with the Potential Employer. You are also responsible for making your own inquiries of the Potential Employer relating to the nature of the employment and making sure that you are comfortable with the nature of the employment and that you consider you have the necessary experience and qualifications for the job.
    • Bozzii does not conduct its own inquiry as to any of the information supplied by the Potential Employerwhen they register with Bozziior the details of any position vacant listed and Bozzii will not be responsible if you do not find the Potential Employer or employment suitable when you attend an interview with the Potential Employer or begin your employment.
    • You understand that you may have certain legal obligations to the Potential Employer or third parties including tax obligations, having the necessary visa and compliance with laws relating to working with children. These are your obligations and Bozzii is not liable to you, the Potential Employer or any third party if you do not meet these obligations.
    • You must not use anyone else’s account or allow anyone else to use your account.
    • You must keep your account details, including password secure and notify Bozzii if anyone has used or attempted to access your account without your permission.

  3. Posting of content
    • Any content you post on the Bozzii website or mobile app must comply with Bozzii’s Website Terms of Use.
    • You will keep ownership of any content you post, however, you grant to Bozzii a non-exclusive, royalty free, perpetual, irrecoverable licence to use the content to promote the Bozzii website and mobile app and for any related uses provided that Bozzii will not commercialise your content without your prior consent.

  4. Termination
    • Either party may terminate this agreement immediately on giving the other party written notice if:
      1. the other party is in breach of any provision of this agreement and the party in breach has failed to remedy the breach within 14 days of receipt of written notice from the other party describing the breach and calling for it to be remedied;
      2. the breach is not capable of remedy;
      3. the other party is unable to pay its debts when they fall due, any steps are taken for the winding up or similar of the other party or the other party takes steps to go into bankruptcy or becomes bankrupt.
    • Either party may terminate the agreement, without cause, by giving the other party 14 days’ written notice.
    • Bozzii may terminate this agreement immediately on giving you written notice if in Bozzii’s opinion, your continued use of the Bozzii’s website and mobile app will or may cause damage or disrepute to Bozzii’s reputation or cause Bozzii to breach any applicable law.

  5. Liability
    • You use the Bozzii’s website and mobile app at your own risk. Both are provided on an “as is” basis.
    • Except as expressly set out in this agreement, and subject to any guarantees, warranties or conditions that by law may not be excluded, all guarantees, warranties andconditions and similar, implied by law or otherwise relating to the services provided by Bozzii under this agreement are excluded.
    • To the extent permitted by law, Bozzii will not be liable for any special, indirect or consequential loss or damage (including personal injury), loss of profit or opportunity arising out of or in connection with the services provided by Bozzii, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

  6. General
    • A notice given under this agreement must be in writing and sent to Bozzii at the address specified at the beginning of this agreement or to Employer at the address on Bozzii’s register. A notice is deemed to be received:
      1. if sent by hand, when delivered to the addressee;
      2. if by post, 7 business days from and including the date of postage, on delivery to the addressee; or
      3. if by email, on receipt by the sender of read receipt. If the delivery or receipt is on a day which is not a business day or is after 5:00pm (addressee’s time) it is deemed to be received at 9:00am on the following business day.
    • In this agreement, references to “employment”, “employing” and similar phrases include references to engaging the Potential Employee as an independent contractor.
    • This agreement is governed by the laws of Victoria and the parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Victoria.
    • If part or all of any of the Member Terms is illegal or unenforceable it will be severed from the MemberTerms and will not affect the continued operation of the remaining provisions of the Member Terms.
    • This agreement can only be amended, supplemented or waived in writing signed, by both parties. The failure of either party to enforce, or the delay by either party in enforcing, any of its rights shall not be deemed a continuing waiver or a modification of this agreement.
